1 Acceptance of Terms
By downloading, installing, or using Key Moments ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
These Terms constitute a legally binding agreement between you and Andre Bohna ("we", "us", or "our"), the developer of Key Moments.
2 Description of Service
Key Moments is a video library and screenshot management application for iOS devices. The App allows you to:
- Import and organize video files
- Capture and save screenshots from videos
- Organize content using tags and favorites
- Sync content across devices using iCloud (optional)
3 User Responsibilities
By using the App, you agree to:
- Use the App only for lawful purposes
- Only import videos and content that you own or have the right to use
- Not use the App to infringe on any third-party intellectual property rights
- Not attempt to reverse engineer, modify, or tamper with the App
- Not use the App to store, distribute, or share illegal content
4 Intellectual Property
App Ownership: Key Moments and all its original content, features, and functionality are owned by Andre Bohna and are protected by international copyright, trademark, and other intellectual property laws.
Your Content: You retain all rights to the videos and screenshots you import or create using the App. We do not claim any ownership of your content.
5 Subscriptions and Purchases
Key Moments may offer optional in-app purchases or subscriptions for premium features. If you choose to make a purchase:
- Payment will be charged to your Apple ID account at confirmation of purchase
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
- You can manage and cancel subscriptions in your Apple ID Account Settings
- Refunds are handled according to Apple's refund policies
For refund requests, please contact Apple Support directly through the App Store.
6 iCloud Services
If you choose to enable iCloud sync:
- Your use of iCloud is subject to Apple's Terms of Service and Privacy Policy
- You are responsible for maintaining adequate iCloud storage space
- We are not responsible for data loss due to iCloud service interruptions or issues
7 Disclaimer of Warranties
We do not warrant that:
- The App will be uninterrupted or error-free
- Defects will be corrected
- The App is free of viruses or other harmful components
8 Limitation of Liability
This includes but is not limited to:
- Loss of data
- Loss of profits or revenue
- Loss of use of the App
- Any damages resulting from unauthorized access to your data
Our total liability shall not exceed the amount you paid for the App or any in-app purchases in the 12 months preceding the claim.
9 Data Backup
You are responsible for maintaining backups of your data. While the App stores data locally and optionally syncs with iCloud, we recommend maintaining separate backups of important content. We are not responsible for any data loss.
10 Termination
You may stop using the App at any time by uninstalling it from your device. We reserve the right to terminate or suspend access to the App for violation of these Terms.
11 Changes to Terms
We may modify these Terms at any time. We will notify users of significant changes by updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the new Terms.
12 Governing Law
These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions. Any disputes arising from these Terms or the use of the App shall be subject to the exclusive jurisdiction of the courts of Thurgau, Switzerland.
13 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
